Oswego Man Being Sued for Negligence and Wrongful Death in Fatal Traffic Accident: Report

The lawsuit is scheduled for an Aug. 29 hearing.

An Oswego man was found guilty of a traffic offense in a fatal car accident earlier this year, according to a report in the Aurora Beacon News.

Craig Schindlbeck, 61, of Oswego, following a bench trial, was convicted of making an improper turn on Randall Road and McKee Street in Batavia in an accident on Feb. 15, 2013, according to the Beacon. He reportedly struck a vehicle driven by David Schele Sr., 61, who later died of his injuries.
Schindlbeck was sentenced to six months of court supervision and fined $300, according to Kane County prosecutors.

However, in June Schele's son, David, sued Schindlbeck for negligence and wrongful death, according to court documents.

Schindlbeck's attorney has denied the claims and instead said Schele was negligent in entering the intersection on a yellow light and failing to slow down or sound his horn.

The lawsuit is scheduled for an Aug. 29 hearing.
