Video Gambling Decision Not Likely to be Revisited

If board chooses to pursue referendum, it must be submitted by Aug. 20.

Several business owners and interested parties attended the Committee of the Whole meeting Tuesday to express concern over the village board's decision to uphold an ordinance that bans video gambling.

The board to not repeal the law, passed in 1935, which would have been toward legalizing video poker and other games in the village.

Debbi Krzeminski, co-owner of the , said she and her fellow business owners respectfully requested that the village revisit the ordinance so that they could move on and work on bringing additional revenue to Oswego.

A petition was circulated in the area, according to Dave Lipsman, owner of , to repeal the ban. More than 600 signatures were collected, 340 which belong to Oswego residents.

John Schwartz from the American Legion, with several other Legion members in the audience, made an appearance as well, saying that the Legion would like to stay in Oswego and continue to support the community, but without the video gambling that may not be an option.

“We have to recognize the elephant in the room,” said Mark Brustowitz of the Fox Valley Kickers, who spoke for several local businesses. He said that after reading the rules and regulations of the gambling act, he found that there are organizations in Oswego that are using programs considered to be gambling.

“There is no question in my mind that these various forms of gambling that take place in the village through well intended organizations and charities,” he said. “At some point I’m urging you to take a look at that ordinance and make a decision. Are we going to ban it completely? Allow some forms of it? And in our interest, allow video gaming?”

Some examples Brustowitz brought up include the 50/50 raffle at the Oswego football games, the “Lucky Duck” contests held at Prairie Fest and the 2012 Fox Bend Men’s league $5 “skin” game.

Village President Brian LeClercq asked in the regular board meeting afterwards what exactly the ordinance said, as now he was being told raffles were illegal.

Karl Ottsen, village attorney, said the state has regulation on raffles and bingo and there was a raffle ordinance passed in the village around 1980 so that licensed individuals or groups can conduct raffles.

“My recommendation is for staff to take a look at what you have permitted and what you have not," Ottsen said. "What types of gambling are going on the community?”

LeClercq suggested updating the 1980 ordinance to include not-for-profit and school groups to be eligible to use raffles and other “gambling” tools for fundraising and the like.

The board then went back to the topic of video gambling and if they should consider discussing it again.

Trustee Tony Giles said that in regards to the petition mentioned by Lipsman, he guessed that the signatures gathered were all taken from a population that were in the group that wanted to see it passed.

“If you’re asking your target population and the best you can get is 1 percent of the population of Oswego, what does that show you?," Giles said.

“I still think video gambling is a drain on our economy rather than a boost, but I would be willing to let it go to referendum,” said trustee Scott Volpe. “I would be willing to follow the recommendations of the voters.”

“Where do we draw the line as public officials, and where does it become we drag things out further and further till we put them on referendums?” then asked Giles. “The water is going to get very muddy.”

Trustee Jeff Lawson then asked if everything would be subject to a referendum when they had a disagreement.  

Volpe said the board had handled the repeal of the ordinance poorly, as they did not fully understand everything that fell under it, which is why he was bringing up the discussion of video gambling.

Lawson asked then what Volpe thought of video gambling, to which Volpe said he would still vote no to it, as it was a terrible funding source.

“Then nothing’s changed,” said Lawson.

If the board decides to pursue adding the issue to the referendum, it must be submitted by Aug. 20.

I must agree that gambling of any kind is a drain. However been to Aurora or Joliet lately. If this tid bit of gambling is going to help maintain and support small struggling business in downtown Oswego, this is a no brainer. Don’t make an example out of the pauper because you are mad at the kings. If I truly thought these people and these machines were a drain on Oswego commerce I would vote to ban it. I highly don’t think that’s the case.

So using that same logic, any business that is having challenges should have video poker then, right?
Heck having some video poker machines in the quilt store downtown might encourage people to shop there more since the spouse could play video poker while the other shops... Same thing with the antique shops...

Put it up for a vote on Novembers Ballot and you will see how the boards majority view is out of touch with what the people want. These so called Village Representatives are so out of touch with the public. All you have to do is attend these pompous Village Hall gatherings which style always trumps substance........

Well you can sort of do that (don't think you can do it in time for November) the law has a provision where you can force a local referendum to ban it (it isn't that hard to do) if the referendum failed you would have your argument.
(230 ILCS 40/70) Sec. 70. Referendum. Upon the filing in the office of the clerk, at least 90 days before an election in any municipality or county, as the case may be, of a petition directed to such clerk, containing the signatures of not less than 25% of the legal voters of that municipality or county, the clerk shall certify such proposition to the proper election officials, who shall submit the proposition at such election to the voters of such municipality or county. The proposition shall be in the following form: -------------------------------------------------------------- Shall video gaming YES be prohibited in ----------------------- .................? NO -------------------------------------------------------------- If a majority of the voters voting upon such last mentioned proposition in any municipality or county vote "YES", such video gaming shall be prohibited in such municipality or county. The petition mentioned in this Section shall be a public document and shall be subject to inspection by the public. (Source: P.A. 96-34, eff. 7-13-09.) Opinion - I have a fulltime job. My wife has a fulltime job. Our kids are in school and very busy.Read More We were taught to vote and those elected to the board of education hires a superintendent and the superintendent manages the school district. We know several board members from the past and two current board members. Hiring administrators? The board approves. Hiring new staff? The board approves. Purchasing computers. The board approves. (And we need more!) The answers to all of your questions? The board is elected by us to do a job. Let them do it. The supt is hired by the board to do a job. Let him do it. I don't have the time or the desire to know everything. That is why I helped HIRE (elect) the board of education. We hear from many in our neighborhood and the replacements are needed because this district needs some changes. Side by side comparisons? Really? That is the job of the board of education. We hear great things are happening. Let's all get behind the new people and show support. Thank you and this is just our opinion.

The school district and park district basically run this town. If you don't like it, leave. That'sRead More the way it has been for 20 years and it isn't going to change. Anytime there is talk of voting down one of their major referendums, the ensuing debate becomes very predictable. Most notably, they threaten to go nuclear and cut sports and the band and that scares residents into shelling out the cash. Remember when the OHS band went to the Rose Bowl parade years ago? There was a referendum not long after that where they said the band would be cut if it didn't pass. Those are the politics these leaches play. And I call them leaches because that's all they are. They suck the blood (property tax cash) from Oswego. There are sooooo many things from over the years I could write here. One that really stands out is a full color booklet that was sent to residents explaining that the Oswego school system was lagging behind and that they needed more money. It was later determined that a construction company paid for the booklet to be sent out. So basically they were trying to convince Oswego residents undercover that we needed more schools..... for them to get the contracts to build. And don't even get me started on the Oswego Ledger newspaper, which has the reach to set the record straight on a lot of things. They are great for coverage of area events and whatnot, but their political coverage has always been a disgrace. I've often wondered if the local government has the paper in their back pocket. That was as of a few years ago. I haven't given them my money since then. Maybe it has changed. If so, I would gladly subscribe again. If you go out into the community and talk about the property taxes and where they are going, everyone agrees that something needs to be done. Don't be fooled by the extremely vocal minority that shows up online (such as on this page) to support the way things currently are.
